Probate Document Preparation Services

 At The Brief Case LLC, we understand that losing a loved one is never easy. The probate process can feel overwhelming, but we are here to assist you with preparing the documents needed to move through the court process.

Our probate document preparation services may include:

1. Set Aside Without Administration (NRS 146.070)

When used: Estate value is $100,000 or less (excluding mortgages and liens).
Who can use it: Surviving spouse or heirs.
Process: A petition is filed asking the court to “set aside” the estate to heirs without appointing a personal representative.
Advantage: Fast and inexpensive — no formal probate.

2. Summary Administration (NRS Chapter 145)

When used: Estate value is less than $300,000.
Process: A simplified probate proceeding with reduced notice requirements and shorter creditor claim periods (60 days instead of 90).
Advantage: Less time and expense than full administration, but still requires court oversight and appointment of a personal representative.

3. General (Full) Administration (NRS Chapters 134–151)

When used: Estate value is $300,000 or more, or if the estate is complex.
Process: A full probate proceeding, including appointment of a personal representative, notice to creditors (90-day claim period),   inventory and appraisal, and final distribution.
Advantage: Provides complete oversight and authority for larger  estates or estates with disputes.               

4. Affidavit of Entitlement (NRS 146.080)

When used: Estate value is $25,000 or less (or up to $100,000 if claimant is a surviving spouse).
Process: Heirs or spouse file an affidavit (no court hearing) to collect  assets directly (like bank accounts).
Advantage: No court proceeding at all — fastest option.

5. Special Petitions

Spousal Set Aside: A surviving spouse may petition to set aside the entire estate in certain circumstances.
Petitions for Transfer: Sometimes used for specific assets (e.g.,    transferring real estate or business interests).
